% 23.02.2018 This contempt petition has been filed by the petitioner alleging noncompliance of order dated July 19, 2017 whereby this Court had allowed the writ petition filed by the petitioner and directed the respondent to convert the property of the petitioner from leasehold to freehold. Mr. Dhanesh Relan, Adv. who appears for the respondents on advance notice states, a communication dated February 9, 2018 has been issued to the petitioner calling upon the petitioner to submit the following:
1. An affidavit from the allottee / lessee on a non-judicial stamp paper for `10/- duly attested by the Notary Public, Delhi, that there is no change in the ownership / constitution of the firm, company since the date of possession to till date;
2. Proof of possession of the property in favour of the person / allottee / firm / company.
3. An affidavit from the lessee / allottee that no Court case / litigation and no mortgage, or Bank Loan is pending in respect of the said property.
4. Four photographs and a copy of Election I. Card / Aadhar Card and two witnesses with I.D. Proof to be present at the time of execution of the same.
5. You are requested to deposit for Rs.5,436/- on A/c of composition fee."
Mr. Relan states, petitioner is required to submit the Stamp Duty for execution of the Conveyance Deed. Learned counsel for the petitioner on the other hand states, petitioner has since complied with the directions of the DDA dated February 9, 2018. He also states, the urgency for execution of the Conveyance Deed is, petitioner has to get herself admitted in AIIMS for Surgery. He also sates, the Stamp Duty for the execution of the Conveyance Deed shall be submitted to the DDA within five days. On such deposit respondent shall convey to the petitioner, the date of execution of the Conveyance Deed. Mr. Relan on instructions states, DDA shall ensure that the Conveyance Deed is executed much before March 5, 2018. His statement is taken on record.
If the petitioner is still aggrieved by any inaction on the part of the respondent, petitioner shall be at liberty to revive this contempt petition. The Contempt Petition is closed.
