O R D E R

The present petition raises a grievance as regards alleged illegal and unauthorized construction subsisting at property bearing No.B-45, land measuring 100 sq. yards, in Khasra No.170 & 170/2, at Noor Nagar, Extension, Johri Farm, Gali No.2, Jamia Nagar, Okhla, New Delhi-110025. 2.

Learned counsel for the MCD, who appears on advance notice, submits that the property in question has already been booked for unauthorized construction and part demolition action has already been taken on 08.04.2024 and 13.05.2024.

It is submitted that further demolition action to remove the subsisting unauthorized construction in the property shall be taken expeditiously. In view of the aforesaid statement made by the learned counsel for the MCD, learned counsel for the petitioner does not wish to press the present petition at this stage; the same is accordingly dismissed as withdrawn, however, taking on record the aforesaid statement of the learned counsel for the MCD. The pending application/s also stands disposed of. 5.

In case there is any deficiency in the action taken by the MCD, the petitioner shall be entitled to avail appropriate remedies, in accordance with law.
