In pursuance of the direction passed by this Court, the respondentMCD has placed on record its status report. Paragraph Nos.3 to 5 of the status report read as under:

"3. That this Hon'ble High Court vide its order dated 27.05.2024 in the instant Petition has been pleased to direct mainly the following: -

2. Learned counsel, as aforesaid, accepts notice on behalf of the respondent no. 1/ MCD.

3. Issue notice to the respondent no. 2, on necessary steps being taken by the petitioner, through all permissible, modes, including electronically. Dasti in addition.

4. Let the MCD inspect the property in question and file a status report within a period two weeks from today.

5. The respondent no. 2 is also at liberty to file a reply, before the next date of hearing.

6. List on 22.07.2024.

4. That pursuant to aforesaid directions, the property has been inspected by the concerned field staff of the answering respondent/ MCD. During inspection, no construction activity has been noticed at this property, however, it has been revealed that the Owner/ Builder of the property is demolishing the old and existing structure. Photographs showing the present Status of the property are annexed herewith as Annexure: A.

That, to prevent any unauthorized construction at this property, a letter bearing No. D/375/AE(B)-IV/CNZ/2024 dated 10.07.2024 has been sent to the SHO, PS Daryaganj with the request to maintain strict vigilance over this property to ensure that no construction work is undertaken without the sanctioned Building Plan from the MCD. Copy of letter dated 10.07.2024 as sent to the SHO, PS Daryaganj is annexed herewith as Annexure: B." 2.

In view of the aforesaid, nothing more is required to be adjudicated except to direct the respondent-Corporation to abide by its statement made in the status report.

The petitioner, however, is granted liberty to re-agitate the issue in case he feels that the respondent-Corporation is not complying with its own undertaking.
