The petitioner, who was enrolled in the respondent/BSF in the rank of a Constable, has been dismissed from service on conclusion of a trial by the Summary Security Force Court on 11.10.2017. Aggrieved by the said order, the petitioner submitted an appeal dated 30.10.2017 to the Appellate Authority i.e. Director General, BSF. The limited grievance of the petitioner is that the respondents have not taken any decision on the said appeal. 2.

Learned counsel for the respondents states, on instructions, that the petitioner's appeal is pending before the DG, BSF and if a reasonable time of four weeks is granted, the same shall be decided and the decision taken, conveyed to him.

In view of the submission made hereinabove, the present petition is disposed of by granting the respondents a period of four weeks to decide the W.P.(C) 995/2018

petitioner's pending appeal by passing a speaking order under written intimation to him. If the grievance of the petitioner still survives, he shall be entitled to seek legal recourse.

The petition is disposed of.
