By way of present petition, the petitioner, who is the complainant before the Trial Court, seeks waiver of the cost imposed upon him vide order dated 20.02.2023 as well as order dated 11.07.2023. 2.

The petitioner, who has argued in person, submits that the request for an adjournment was necessitated by an unfortunate accident met by his counsel. He submits that while seeking waiver of the cost, the application was also accompanied by a medical certificate, which certified that the counsel had suffered an accident and was advised one week's rest. He submits that the adjournment sought was unintentional and due to reasons beyond the petitioner's control.

Considering that though on the first date, the petitioner could not produce the medical certificate, however, while seeking waiver of cost, medical certificate of the petitioner's counsel was placed before the learned Trial Court. During the course of submissions, the petitioner submits that as a good gesture, he would deposit Rs.5000/- with the DSLSA. Considering the averments and the fact that the medical certificate was subsequently placed on record, the costs imposed vide orders dated 20.02.2023 and 11.07.2023 are waived of. Let the petitioner deposit a sum of Rs.5000/- with Delhi State Legal Services Authority (A/c No. 18580110053263, UCO Bank, Branch:

Rouse Avenue, IFSC:

UCBA0003364) within a period of one week from today. The amount so deposited shall be utilized by the DSLSA for providing counselling/psychological support to POCSO victims requiring such assistance.

In view of the above, the petition is disposed of alongwith pending applications.
