% 12.01.2026 Learned counsel appearing for the respondent submits, that the parties have settled their inter-se disputes; and the petitioner has paid to the respondent an amount of Rs. 11.25 under that settlement. Consequently, counsel submits that the respondent does not wish to oppose the present revision petition.
The parties, who are present in court, also confirm the above submission.
In view of the above, the petitioner prays that the impugned judgment of conviction and impugned order of sentence be set-aside. Accordingly, the present revision petition is allowed. Impugned judgment dated 17.08.2022 passed by the learned sessions court, whereby CA No.99/2019 was dismissed, is set-aside. Judgment dated 24.10.2019 and sentencing order dated 22.11.2019 passed by the learned Magistrate in CIS / CC No.296/2019 are also set-aside. Consequently, the revision petitioner stands acquitted of the offence under section 138 Negotiable Instruments Act, 1881.
