The present petition has been filed under Article 226/227 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 on behalf of the petitioner seeking the following reliefs:- "A. Issue an appropriate writ, order or direction in the nature of certiorari/mandamus or any other writ, directing the concerned Ld.

arguments in the proceedings arising out of Section 156(3) CrPC application Yiled by the Petitioner in Ct. Case no. 8199/2022 titled as Rajneesh Arora versus Rajiv Kumar & Ors; and/or B. Modify and/or clarify the order dated 03.04.2025 passed by the Ld. PD&S Judge, N-W, Rohini District Courts, Delhi in Criminal Revision No. 399/2024 titled as Rajneesh Arora versus State & Ors, to the extent that the direction for appearance of "parties" before the Magistrate shall not be construed as permitting the proposed accused to participate in the adjudication of section 156(3) CrPC proceedings; and/or C. Pass any other or further orders, which this Hon'ble Court deems fit and proper in the interest of justice."

The learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file appropriate petition before the appropriate forum, in accordance with law. 5.

Permission and liberty, as prayed for, is granted. 6.

The petition is, accordingly, dismissed as withdrawn.
