Mr. Jagdeep Kishore, plaintiff appearing in-person submits that during pendency of the present suit, the parties were referred to mediation, where they had arrived at settlement, terms whereof reduced in writing in the form of settlement agreement dated 13.08.2024. He submits that the said settlement has been acted upon.

He further contends that preliminary decree dated 30.05.2023 was passed by this Court whereby the plaintiff, as well as, defendant no.1 were declared owner of the suit property to the extent of 50% share each. 3.

He submits that in terms of the above referred settlement agreement dated 13.08.2024, the plaintiff has gifted his share in the suit property in favour of his former wife, therefore, the locus of the plaintiff to seek The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. partition no more survives in the present suit. 4.

Accordingly, prayer is made to dispose of the suit in terms of the settlement. The prayer is not opposed by Mr. Prashant Mendiratta, learned counsel appearing on behalf of defendants.

In view of the above, the suit along with pending applications is decreed in terms of the settlement agreement dated 13.08.2024, which shall form part of the decree.
