Petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'BNSS'), has been filed on behalf of the Petitioners for interim protection.

It is stated that complainant, i.e. Respondent No.5, filed a complaint on 29.01.2025 that the parents of the Petitioner No.2 were unhappy with the choice of Petitioner No.2 regarding marriage. A complaint was made to Police Station Geeta Colony by Petitioner No.2 regarding the same. Petitioner Nos.1 and 2 got married on 31.01.2025 according to Hindu rituals from Arya Samaj Vaidik Vivah Sanskar Trust, Ghaziabad and later got their marriage registered in the Office of Marriage Registrar, Ghaziabad on 31.01.2025.

Petitioner No.1 went to her home to visit her parents, but she was harassed and tortured by the family members along with Respondent No.5, because the family was unhappy with her marriage with Petitioner No.1, who did not belong to their caste.

Petitioner no.1 tried calling Petitioner No.2, but did not get any response. He got worried and went to the house of Petitioner No.2, where family members of Petitioner No.2 did not allow him to meet her and started abusing and giving death threats to him. The Police was called at No.112 and Petitioner no.1 briefed them on the matter and Petitioner no.1 had to return home alone. However, somehow, Petitioner No.2 managed to escape from her house, saving her life from her family. 8.

It is asserted that Petitioner No.1 is getting continuous calling and death threats from the family of Petitioner No.2 and Respondent No.5 is continuously telling them that they were against the marriage from the very beginning. A complaint was made in Police Station Dwarka. The family of Petitioner No.2 went to the house of her friend and started abusing and harassing them and told them that if they found Petitioner Nos.1 and 2, they would not leave them alive as they cannot see their daughter getting married The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Hence the prayer is made that Respondent Nos.2 and 3 be directed to provide adequate and immediate police protection to the Petitioners to ensure their safety and security.

Learned ASC has appeared on advance notice on behalf of the State, who submits that necessary directions shall be complied with. 11.

In view of the submissions made, the mobile numbers of SHO and beat constable be provided to the Petitioners and also regular visits be made by the beat constable to ensure safety and security of the Petitioners. 12.
