CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 08.02.2018 Respondent No. 2 Ms. Pawandeep Kaur is present in court along with her counsel and has been identified by SI Rakesh Malik of Police Station Seema Puri. Respondent No. 2 says that she has settled the matter with petitioner no.1 of her own free will, voluntarily and without any undue force, pressure or coercion before the Delhi Mediation Centre, Karkardooma Courts on 15.07.2016. Her marriage with petitioner no.1 has already been dissolved by a decree of divorce by mutual consent dated 11.07.2017 passed by Family Court, Shahadra District, Karkardooa Courts, Delhi.

Petitioner has paid `5,00,000/- by way of demand draft, photocopy whereof is on record. Respondent No. 2 says that with this payment, entire settlement amount of `20,00,000/- stands received.

She says that she has no objection in case FIR is quashed against the petitioner no.1 and petitioner no.2, mother of petitioner no.1. Keeping in view the settlement arrived at between the petitioner No.1 and respondent no. 2 voluntarily coupled with the fact that marriage between the petitioner no.1and respondent no. 2 has already been dissolved, no fruitful purpose would be served to keep the criminal proceedings pending.

In the interest of justice, FIR No.261/2013 under Sections 498A/406 IPC and Section 4 of Dowry Prohibition Act, registered at police station Seema Puri and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous. Dasti. A.K. PATHAK, J FEBRUARY 08, 2018 sm
