By way of the present application, the applicant seeks grant of regular bail in FIR bearing No.695/2024, registered at Police Station Begumpur, Delhi for the commission of offences punishable under Sections 64 of the Bharatiya Nyaya Sanhita, 2023 (hereafter 'BNS') and Section 6 of the Protection of Children from Sexual Offences Act, 2012 (hereafter 'POCSO Act').

The allegations against the accused/applicant as disclosed in the FIR are that the victim and the accused were friends and she used to accompany the accused/applicant, being in a friendly relationship with him, at various places and had entered into a physical relationship with him in April, August and September of 2024. Resultantly, she had conceived and a complaint was lodged with the police. years and 05 months old and the accused was about 18 years of age. 3.
The victim is present before this Court along with her father and states that she was in a friendly relationship with the accused and the relations between her and the accused were consensual. She and her father stated that they have no objection if the accused/applicant is granted bail as he had not forced the victim to get into sexual relationship. 4.
At the time of lodging of the FIR the age of the victim was 17 years 10 months and 15 days. Therefore, it is clear that it was a case of consensual relationship, though the victim in this case was about one and a half months less than attaining the age of majority.

Considering the overall facts and circumstances of the case, the age of the victim as well as the accused who was only about 18 years of age, the fact that both of them were known to each other and do not want the accused to remain in judicial custody as they contemplate getting married to each other, this Court is inclined to grant regular bail to the applicant on his furnishing personal bond in the sum of Rs.10,000/- with surety of the like amount to the satisfaction of the Trial Court/Successor Court/Link Court/Duty Judge concerned on the following terms and conditions: i) The applicant shall surrender his passport and not leave the country without prior permission of the concerned Court. ii) The applicant shall share his mobile number with the concerned IO/SHO, and shall keep the same switch on/active at all times. iv) In case of change of residential address/contact details, the applicant shall promptly inform the same to the concerned Court. 6.
Accordingly, the present application stands disposed of. 7.
