An application under Section 438 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner for grant of anticipatory bail in FIR No. 292/2018 under Sections 354/354A/328 IPC registered at P.S. Sunlight Colony. Chargesheet has been filed under Sections 354/354A IPC.

Issue notice. Learned APP for the State appears on advance notice and accepts notice.

Learned counsel for the petitioner submits that FIR pertains to the year 2018 and chargesheet has already been filed on record. He further submits that version of the complainant could not be corroborated during investigation with respect to alleged drugging and as such Section 328 IPC has not been invoked. The petitioner is stated to have been falsely implicated.

On the other hand, learned APP for the State opposes the application but admits that the petitioner is no longer required for purpose of investigation, since chargesheet has already been filed. 5.

Considering the totality of facts and circumstances and without expressing any opinion on merits of the case, since petitioner has already joined investigation and chargesheet has been filed on record, in the event of arrest, petitioner be admitted to bail on furnishing a personal bond in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) with one surety in the like amount to the satisfaction of IO/SHO, P.S. concerned/learned MM and subject to following conditions:

(i) Petitioner shall provide his mobile number to the Investigating Officer (IO) / SHO concerned;

(ii) Petitioner shall not threaten or influence the witnesses in any manner;

Application is accordingly disposed of. Pending applications, if any, also stand disposed of.

A copy of this order be forwarded to the learned trial court for information.
