% 07.01.2019 After some arguments learned counsel for the petitioner says that the petitioner shall not raise any objection qua merits of the impugned order if he is allowed to stay in the premises for further six months. Needless to say the eviction order was passed on 07.11.2017. It is submitted by learned counsel for the respondent that since no rent has been paid since 1986 hence the rent from three years prior to filing of petition under section 14(1) (e) of Delhi Rent Control Act uptill 31.12.2018 be directed to be paid to the respondent by the petitioner. The agreed rate of rent was Rs.55/- per month. Hence, the petitioner shall pay to the respondent within six weeks from today the entire arrears of rent @ Rs.55/- per month, as directed above.
From 1st January, 2019 the petitioner shall pay the user/occupation charges @ Rs.10,000/- per month which shall be payable on or before 7th of each calendar month besides the water and electricity charges payable as per actuals. Undertaking to this effect shall be filed by the petitioner within two weeks from today. It is made clear if this condition is violated the respondent shall have a right to execute the eviction order forthwith. The petitioner shall positively vacate the premises on or before 6th July, 2019.
