O R D E R

% 06.07.2018 The present petition under Article 226 of the Constitution of India instituted on behalf of the petitioner-student prays as follows:- "(a) Writ of Mandamus or any other Writ/Orders/Directions may be passed to the Respondents for issue of Class Xth Secondary School Examination Certificate (Session 2014-16) with changed name 'Shaurya Gupta' and also issue Class XIIth Senior Secondary School Examination Certificate (Session 2017-18) to the petitioner with changed name 'Shaurya Gupta' in school records. And/or (b) Pass any other order which this Hon'ble Court may deem fit in the facts and circumstances of the present case."

Having heard learned counsel appearing on behalf of the parties and perused the material on record, it is evident from the admission form, as well as, the admission and withdrawal register, maintained by the respondent No.2 school, attended by the petitioner, that his name at all the relevant times is reflected as 'Shaurya Gupta' in the relevant records; as distinguished from 'Shorya Gupta', which is the name reflected in the Class X Secondary School Examination Certificate, issued by the CBSE. In view of the foregoing discussion, the present petition deserves to be allowed.

The present petition is disposed of with a direction to the CBSE to correct the name of the petitioner to 'Shaurya Gupta' in Class Xth Secondary School Examination Certificate (Session 2014-16) as also the Class XIIth Senior Secondary School Examination Certificate (Session 2017-18) and the relevant marksheets.

The petitioner is, however, directed to surrender the original certificates and mark sheets to the CBSE to enable the latter to carry out the above corrections.

With the above directions, the writ petition is disposed of. Dasti.
