Both these petitions arise out of criminal proceedings in connection with FIR No. 48/2005 dated 14.11.2005, registered at Police Station AntiCorruption Branch, Delhi, under Section 13(1)(d) of the Prevention of Corruption Act, 1988, and Section 120B of the Indian Penal Code, 1860. 2.

The State has filed CRL.M.C. 3638/2025 against orders of the learned Special Court dated 19.02.2025 and 16.05.2025, wherein certain CRL.M.C. 3638/2025 & connected matter. observations were made against the prosecution. The accused, on the other hand, has filed CRL.M.C. 3858/2025 for quashing of the FIR. 3.

I am informed that, during the pendency of these petitions, the prosecution filed the chargesheet; however, the Special Court declined to take cognizance and to summon the accused, noting that the material placed on record was insufficient to establish the essential ingredients of Section 13(1)(d) of the Prevention of Corruption Act, 1988. 4.

In these circumstances, Mr. Sanjeev Bhandari, learned Additional Standing Counsel for the State, submits that the State does not wish to press CRL.M.C. 3638/2025.

CRL.M.C. 3858/2025 has also been rendered infructuous by reason of the aforesaid order, and Mr. A.K. Trivedi, learned counsel for the petitioner therein, seeks disposal of the petition. 6.
