The petitioner has filed the present petition inter alia praying as under:

"A. Direct the Respondents not to dispossess or obstruct or disturb the Petitioners in carrying on his trade from his site i.e. between Gate No. 1 & 2, Safdarjung Hospital, New Delhi, in terms of section 3(3) of the street vendors {Protection of Livelihood and Regulation of Street Vending} Act 2014 and;

B. Direct the Respondents/Town Vending Committee to conduct the survey of the Petitioner within time bound manner and to issue certificate of vending in favour of the Petitioner as per the provisions of the Street Vendors {protection of livelihood and regulation of street vending} Act 2014."

The petitioner has not been issued the certificate of vending as yet. conducted in the year 2018 and his name does not feature in the list of 628 unauthorized street vendors which was drawn up earlier. Notwithstanding the same, learned counsel for the respondent submits that the petitioner would be entitled to participate in the survey which is likely to be conducted shortly. The Town Vending Committee will consider all documents and materials that may be supplied by the petitioner. 3.

The respondents are bound down to the said statement. 4.

The survey has not been completed as yet. We direct that in the event the petitioner is found eligible, the certificate of vending be issued to the petitioner.

In view of the above, the petition is disposed of. Pending applications stand disposed.
