The petitioner has filed the present application under Section 439 for grant of bail.

Learned counsel for the petitioner submitted that the petitioner has been falsely implicated in the present case. Even otherwise, the prosecutrix has already been examined. 3.

Learned counsel for the petitioner further submitted that the petitioner is in custody since 17.5.2019 and is no more required for the purpose of any investigation or recovery. 4.

On the other hand, learned APP opposes the bail application. However, learned APP, on instructions, submitted that the prosecutrix has already been examined and no other public witness is required to be examined.

Taking into consideration the allegations made against the petitioner, his judicial custody and the fact that the

prosecutrix has been examined, I deem it to be a fit case to grant bail to the petitioner.

Accordingly, the petitioner is admitted to bail and he be released, if not required in any other case, subject to his furnishing a bail bond in the sum of Rs.25,000/-, with one surety of the like amount to the satisfaction of the Trial Court and further subject to the conditions that the petitioner shall not involve in any activity which may prejudice the prosecution; that the petitioner shall not influence the witnesses in any manner; that the petitioner shall not tamper with the evidence and that the petitioner shall not contact the complainant/prosecutrix or her family members in any manner. In case any complaint is received, the prosecution may move an application for passing appropriate orders under the law for the breach of the aforesaid conditions.
