This hearing has been done through hybrid mode. 2.

The present petition under Sections 2(b) and Section 12 of the Contempt of Courts Act, 1971 read with Article 226 of the Constitution of India seeks the following prayers:

"I. Pass an order directing the Contemnors to comply in letter and spirit the directions contained in the order dated 09.05.2019 in WP (C) 3723 of 2019 whereby Hon'ble Court had recorded the statement of Municipal Corporation of Delhi that MCD will not remove the petitioner and despite that MCD has attempted to remove the petitioner, which shows wilful disobedience of the order passed by this Hon'ble court.

Initiate Contempt proceedings against the Contemnors and Punish them for wilful disobedience of the Order dated 09.05.2019 passed by the Hon'ble High Court in WPC No. 3723/2019. III. for having willfully and deliberately not complying with the order passed by this Hon'ble Court.

IV. Pass any such directions or order that this Hon'ble Court deems fit and proper in the facts and circumstances of the abovementioned case." 3.

Vide order dated 09.05.2019 in W.P.(C) 3723/2019, the leaned Division Bench passed the following directions: "This is a petition under Article 226 of the Constitution of India filed by the petitioners. Fear of dispossession has led to the filing of the present writ petition. Ms. Sangeeta Chandra, learned counsel for the SDMC submits that for the present, there is no proposal to remove the petitioners.

In view of the statement made, the learned counsel for the petitioners does not press the present petition and submits that the petitioners will approach this Court if there is any fear of dispossession.

The petition is dismissed as not pressed.

CM.APPL 17095/2019 also stands disposed of.

We make it clear that we have not expressed any opinion on the merits of the matter."

Learned counsel for the petitioner does not wish to press the present petition with liberty to initiate appropriate proceedings in accordance with law before the Court of competent jurisdiction.
