% 16.10.2025 Learned counsel appearing for the appellant seeks leave to withdraw the present appeal, submitting that the matter has been settled in mediation conducted before the learned District Court.

Counsel also requests for refund of the court-fee paid. The matter is at the pre-notice stage.

In view of the above, the appeal is disposed-of as withdrawn. Pending applications, if any, also stand disposed-of. In view of the decision of a Division Bench of this court in Nutan Batra vs. M/s Buniyaad Associates1, the Registry is directed to refund the entire court fees, since the parties have settled the matter through mediation which attracts the applicability of section 16 (not section 16-A) of the Court Fees Act.
