Heard the learned counsel for the parties.

The documents submitted by the learned counsel representing the respondent no.1 are taken on record.

By instituting this petition under Article 226 of the Constitution of India, the petitioner has prayed for issuing a direction to respondent no.1tendering authority to reject the technical bid of respondent no.2 in the subject tender.

The ground of seeking the prayer in this writ petition is that the respondent no.2 has relied upon certain allegedly forged documents in support of his bid.

Learned counsel representing the respondent no.1, Mr. Ankur Mishra, has brought to our notice the fact that on receipt of the complaint of the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. petitioner in respect of respondent no.2, certain enquires were made by the tendering authority from the OEMs. He has further stated that a show cause notice has been issued on 25.04.2025 by the tendering authority to the respondent no.2 requiring the respondent no.2 to show cause as to why action for disqualification from the current tender and black listing may not be taken. Mr. Ankur Mishra, learned counsel representing the respondent no.1 has brought to our notice another show cause notice dated 02.05.2025 issued to the respondent no.2.

The said documents have also been tendered to the learned counsel for the petitioner.

In view of the aforesaid, since an action against the respondent no.2 into the complaint submitted by the petitioner is already in contemplation, in fact, that the same is going on, we dispose of the said petition with a direction to the respondent no.1 to take appropriate decision in accordance with law in pursuance of the show cause notices to the respondent no.2.
