O R D E R

This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- "i. Issue an appropriate writ, order of direction in the nature of Mandamus thereby directing the respondent authorities to grant requisite permission to the petitioner society under the provisions of Delhi School Education Act and Rules, 1973 to close down and de-affiliate the private un-aided school namely "Ring Midways Sr. Secondary Public School, Vipin garden, main Najafgarh Road, near Dwarka Metro Station, New Delhi, established and run by the petitioner society;
ii. Issue an appropriate writ, order or direction in the nature of Certiorari thereby setting aside and quashing the impugned order dated 10.05.2023 passed by the respondent no. 1 for taking over the management of the above named private un-aided school under Section 20 (1) read with The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The case of the petitioner is that in terms of the Delhi School Education Act and Rules, 1973, the petitioner wishes to close down and disaffiliate the private unaided school, namely "Ring Midways Sr. Secondary Public School, Vipin Garden, Main Najafgarh Road, Near Dwarka Metro Station, New Delhi", primarily due to financial position of the society and the number of admissions in the school. 3.
Learned counsel for the petitioner states that it has become impractical to run the school when the majority of teachers and students have left the school.

After a considerable period of time, this Court on 02.09.2024, directed the Directorate of Education to decide the representation of the petitioner made in the year 2013.

The Directorate of Education in accordance with the directions and after forming a committee, considered the representation of the petitioner and on 03.12.2025, ordered as under: "And whereas, the committee recommended following considerations duly approved by Director (Education)- I. De-recognize the school;
II. suitably shift the children as per their convenience in consultation with their parents;
III. settle the payments to be made to the Staff as per Plan submitted with Hon'ble High Court and then; IV. leave it to the Hon'ble High Court to decide whom to hand over the possession of the building.

Therefore, considering the facts and circumstances as well as in compliance with the direction of Hon'ble High Court, I, Deputy Director of District West -B, order to de-recognize the school Ring Midways Sr. Sec. School, Vipin Garden, Main Najafgarh Road, New Delhi - 110059, w.e.f, 01.04.2026, if the valid management of the school/society is ready to take responsibility and pending liabilities of the school."

With regard to direction No. 2, Mr. Tewathia, learned counsel for the petitioner states that there are 83 students studying in the school and as regards the EWS category students, Mr. Gupta, learned counsel for the respondent states that they will be accommodated in the nearby government school under the EWS category and as regards the general category students, as and when the admissions are made, the respondent No.2 shall grant recognition to those students. 7.
The petitioner shall provide all assistance and documentation in that regard.

As regards the direction No. 3 is concerned, the amount of 1.42 crores lying with the petitioner school, has already been credited to the account which is managed by Directorate of Education and the Directorate of Education will disburse the arrears in accordance with the directions contained in the order dated 14.01.2026 passed in W.P.(C) 4753/2018.

If there are arrears of any of the staff members, they are entitled and free to avail of their rights in accordance with law. 10.

movable properties including the school bus of the petitioner school expeditiously and appropriate the money towards the arrears of the staff salaries.

The petitioner school will execute all necessary documents in this regard and will not claim any right to the movable properties sold by Directorate of Education.

The entire exercise will be completed before 09.05.2026 and immediately within one week thereafter, the petitioner shall hand over vacant and peaceful possession of property ad measuring 4,000 sq. yards, khasra no 1/141//2 and 1/15, Vipin Gardem, main Najafgarh, Uttam Nagar, Delhi-59, to the lessor.

The petitioner shall also take steps to register the students with CBSE/respondent No.2 immediately.
