The present petition has been filed seeking following reliefs: "a) Issue a writ of or in the nature of mandamus directing the Respondent to refer the matter to Central Bureau of Investigation in accordance with the Vigilance Manual of the Central Vigilance Commission for investigation in a time bound manner;

b) Pass an order awarding cost of the present proceedings to the Petitioner."

petitioner submits that he will not press the present petition any further in case a direction is given to the respondent/DDA to treat the same as representation and dispose of the same in a time bound manner. 5.

In view of limited innocuous prayer made by Mr. Malhotra, the present petition is disposed of with a direction to the respondent/DDA to consider the present petition as representation of petitioner, which will be disposed of by the respondent/DDA by a speaking order within a period of 10 weeks from today.

The order so passed by the respondent/DDA will be communicated to the petitioner within a period of two weeks thereafter. 7.

Needless to say that the present order has been passed without prejudice to the rights and contentions of the present petitioner. The petitioner shall be at liberty to approach the court against the speaking order passed by the respondent/DDA, if so advised.

The petition is disposed of in the aforesaid terms. Consequently, the pending application also stands disposed of.
