The present writ petition has been filed for extending the contract period of the catering stall SMU No. JSME-2-3-02 at Jasidih Railway Station at platform no. 2/3 in between pillar nos. 5,6, 7 & 8 at Howrah end. 2.

In the present case, the Railway Administration allotted the aforesaid license to the petitioner on 14th October 2019. As per the Master License Agreement dated 20th December, 2021, the license was for a period of five

(5) years from 10th March 2021 to 9th March 2026. 3.

Counsel appearing for the petitioner submits that he may be granted further extension of 7 months beyond the dies non period, as given in other similar cases. Reliance is placed on orders passed in WP(C) 225 of 2025 dated 10th January 2025, WP(C) 6771/2024 dated 30th May, 2024, LPA No. 746/2024 dated 5th August, 2024 and SLP(C) No. 19229/2024 dated 27th August, 2024.

Despite repeated opportunities, no counter-affidavit has been filed till date.

Counsel for the petitioner submits that the petitioner is similarly placed as the petitioners in the aforesaid cases. 6.

I have heard the counsel for the parties and perused the aforesaid orders/ judgments relied upon by the petitioner. 7.

Following the directions passed in the aforesaid orders/judgments and on principles of parity, it is directed that subject to payment of license fee, the petitioner shall be allowed to operate the aforesaid stall for a further period of seven (7) months with effect from 10th March, 2026. 8.

The petitioner shall file an undertaking by way of an affidavit within two (2) weeks from today that they shall vacate the said stall after the expiry of the extended period of seven (7) months, failing which the respondent shall be at liberty to remove their goods from the stall. 9.

The present petition along with all pending application(s) stands disposed of in terms of above.
