% 04.02.2026 1.
After hearing arguments at some length, learned counsel for petitioners, without prejudice to his rights and contentions, does not press the present petition. He submits that he would raise the points agitated in the present petition before the learned Trial Court, at appropriate stage. 2.
He, however, submits that since both the petitioners herein, who are on bail, are settled in a village situated in Tamil Nadu, they may be granted exemption from personal appearance, through their counsel. 3.
Learned counsel for the respondent No.2 i.e. complainant, has no objection in this regard.
4.
In view of the above, present petition is disposed of as not pressed. 5.
All rights and contentions of the parties are left open to be adjudicated by the learned Trial Court at appropriate stage. 6.
Both the petitioners are granted exemption from personal appearance, and would be permitted to represent themselves through their counsel. However, an application to that effect along with their affidavits be laid in this regard before the learned Trial Court, within four weeks from today. 7.
Indubitably, as and when, learned Trial Court feels their presence imperative, they would appear physically.
8.
Needless to emphasize, the interim order stands vacated. 9.
A copy of this order be sent to learned Trial Court for information.
