Through the instant writ petition, filed under Article 226 of the Constitution of India, the Petitioners seeks to substitute the seized moveable properties of the Petitioners i.e., three vehicles, which have been currently seized in an action initiated under Section 17 of Prevention of Money Laundering Act, 20021 5.
Mr. Madhav Khurana, Senior Counsel for Petitioners, submits that the Petitioners are willing to offer the value of the seized articles in cash/FDs. 6.
Issue notice. Ms. Shiva Lakshmi, CGSC for Respondent No. 1 and Mr. Manish Jain, Spl. Counsel for Directorate of Enforcement, accept notice.

Mr. Jain, without prejudice to the rights of the ED, submits that since the seized properties are vehicles, which are depreciable in nature, the same can be released on superdari, subject to payment of an amount equivalent to the value of the seized property as denoted in the Insurance Certificate or as per present value of the property, whichever is higher. He further submits that the value of such property may be deposited to the Directorate in the form of a Demand Draft, in favour of "Joint Director, Gurugam Zonal Office" (A/c No. 924020049920405, Axis Bank, MG Road, Gurugram). 8.
In light of the above, the present petition is disposed of with a direction that the three seized vehicles, detailed in paragraph No. 9 of the petition, be released on superdari to the Petitioner, subject to deposit of the value of the said vehicles as mentioned in the latest Insurance Certificate. The deposit be made in the name of "Joint Director, Gurugam Zonal Office" (A/c No. 924020049920405. Axis Bank, MG Road, Gurugram).
