The learned counsel for the petitioner submits that the chargesheet has been filed under Sections 406/420 of the Indian Penal Code, 1860 ('IPC').

He submits that in the facts of the present case, charges both under Sections 406 and 420 of the IPC cannot be levied together.

He, however, submits that since the chargesheet has already been filed, he would take all arguments before the learned Trial Court.

He seeks liberty to withdraw the present petition. 5.
