% 30.05.2025 CS(OS) 510/2022 I.A. 14290/2025 (Under Oder XXIII Rule 1 CPC) 1.

This is an application filed by the plaintiff under Order XXIII Rule 1 of the Code of Civil Procedure, 1908 ('CPC') seeking permission to withdraw the present suit in terms of family settlement dated 11.03.2025. 2.

The application is supported with the affidavit of all the five (5) plaintiffs. Plaintiff Nos. 2, 3, 4 and 5 are present in person and are identified by their counsel.

Learned counsel for defendant nos. 6 to 12 confirms the submissions of the plaintiffs and states that defendant nos. 6 to 12 will remain bound by the family settlement dated 11.03.2025. He states that in fact similarly the defendant nos. 6 to 12 are withdrawing the CS(OS) No. 751/2022 filed by them, which is separately listed today.

The parties to the settlement deed dated 11.03.2025 undertake that they will abide by the said settlement.

In view of the above, the application is allowed and the suit is dismissed as withdrawn.
