The learned counsel for the plaintiffs submits that the present is a suit seeking partition of the suit properties. He submits that the plaintiffs and the deceased defendant were siblings.

He further submits that during the pendency of the suit, the sole defendant has passed away and he is not survived by any Class-I legal heirs, therefore, the right to sue does not survive. He, therefore, seeks to withdraw the present suit.
