% 26.02.2018 It is submitted that petitioners and respondent no.2 are neighbours. It is submitted that petitioners and respondent no. 2 have settled their disputes amicably;

therefore, FIR No.403/2013 under Sections 323/354A/506/509/34 IPC registered at Police Station Rani Bagh on the complaint of respondent nol. 2, may be quashed.

Learned APP for State submits that third accused, namely, Vinay Kukku has been declared proclaimed offender. Accordingly, FIR may not be quashed.

Learned counsels for the petitioners and respondent no. 2 submit that

compromise has been arrived at between the petitioners and respondent no. 2; therefore, aforesaid FIR may be quashed against the petitioners. Respondent no. 2 is present in Court along with her counsel and has been identified by SI Raju Yadav of police station Rani Bagh. Petitioners have tendered apology, which has been accepted by the respondent no. 2. Respondent no. 2 admits having settled the matter with petitioners of her own free will, voluntarily and without any undue force, pressure or coercion. Respondent no. 2 submits that she has no objection in case FIR is quashed against the petitioners.

Keeping in view of the settlement arrived at between the petitioners and respondent no. 2, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.

Accordingly, in the interest of justice, FIR No.403/2013 under Sections 323/354-A/506/509/34 IPC registered at Police Station Rani Bagh and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous. Dasti.
