This hearing has been done through video conferencing. CM APPL. 1554/2021 (for recall) and CM APPL. 1610/2021 (for stay) in WP(C) 8615/2019 2.

This is an application filed by the ld. counsel for the Petitioner who appeared on 6th February, 2020. The applicant claims that the letter dated 4th January, 2019, which was the basis of the order passed on 6th February, 2020, disposing of the writ petition, was forged and fabricated. 3.

Vide order dated 6th February, 2020, this Court had directed the payment of a sum of Rs. 49 lakhs as compensation to the Petitioner. The matter was also considered by the Hon'ble Supreme Court in SLP 9080/2020, titled Rihana Begam (Widow) v. Union of India, wherein, vide order dated 7th January, 2021, it was directed that the amount of compensation of Rs. 72,00,000/- which is the revised compensation, be transferred to the account of the Estate Officer. The same counsel, who has filed the present application, also raised a plea before the Supreme Court, that his professional fee has not been settled. SINGH NAYAL 12:58:56 Supreme Court did not look into this particular claim, however the counsel was given liberty to approach the Estate Officer to raise his claims, in accordance with law.

Issue notice to the Petitioner, as also to the ld. counsel for the DMRC, returnable on the next date.

It is directed that if the Estate officer receives the compensation amount, in view of the allegations made that the letter was forged and fabricated, the compensation in favour of the Petitioner shall not be disbursed during the pendency of these applications. 6.

Mr. Satyakam, ld. Standing Counsel, who is present in Court, is directed to inform the Estate Officer of this order. 7.
