Learned counsel for the respondents states that he has obtained instructions to the effect that the order dated 08.07.2017 passed by the Disciplinary Authority removing the petitioner from service is appealable before the DIG, ITBP. He submits that instead of exhausting his statutory remedy, the petitioner has approached this Court directly which is not permissible.

In view of the aforesaid, we are not inclined to entertain the present petition till the petitioner exhausts the statutory remedy of appeal available to him in law.
