Issue notice. Mr. Raghuvinder Varma, learned APP accepts notice on behalf of the State.
3.
Brief facts of the present care are that on 18.08.2017, an unfortunate motor vehicle incident took place between the vehicles of the petitioner and respondent no. 2 herein. In the said motor vehicle accident, no occupant was injured or hurt and only the vehicles were damaged. Later on the complaint of the respondent no. 2, the present FIR came to be registered. Thereafter, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
petitioner offered to settle the matter with respondent no. 2 to which he agreed and a Settlement Deed dated 09.12.2024 was entered into between the parties. That as per the settlement, petitioner offered to pay a total sum of Rs. 45,000/- to respondent no. 2 so as to compensate for the damage to his vehicle and respondent no. 2 has voluntarily agreed for the same. Out of the aforesaid sum, an amount of Rs. 20,000/- has already been paid to respondent no. 2 against the receipt on the date of signing of the Settlement Deed dated 09.12.2024. It is stated that the balance amount of Rs. 25,000/- is to be paid upon the quashing of the present FIR, as agreed by the parties in the Settlement Deed dated 09.12.2024 4.
Considering the same, the parties are present in person before this Court and have been identified by their counsels and Investigating Officer concerned.
5.
The complainant who is present in person before this Court, states that he has no objection, if the present FIR is quashed. 6.
In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion, I am of the opinion that no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. Moreover, there is no legal impediment in quashing the FIR in question.
7.
Accordingly, FIR bearing no. 342/2017, registered at Police Station Maurya Enclave, Delhi, for the commission of offences punishable under Section 279 of IPC and all consequential proceedings emanating therefrom are quashed, subject to petitioner depositing a sum of ₹ 20,000/- in the Delhi The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
