$~57 *
IN THE HIGH COURT OF DELHI AT NEW DELHI
+ W.P.(C) 8635/2019 & CM Appln. No.35676/2019 RAJAGOPAL VISWANATHAN ..... Petitioner Through Counsel(appearance not given) versus UNION OF INDIA & ORS ..... Respondents Through Eshita Baruah, Adv. for Mr. Gaurang Kanth, Adv.
CORAM:
HON'BLE MR. JUSTICE VIBHU BAKHRU
O R D E R
% 08.08.2019 1.
The petitioner has filed the present petition, inter alia, praying that respondent nos.1 and 2 be directed to modify the compensation formula as disclosed in Press Release dated 29.11.2018.
The issues, whether respondent nos.1 and 2 could direct payment of such compensation and whether the same is binding on respondent no.4, are questions that are being considered in other petitions filed by respondent no. 4 company. 2.
It is clarified that the petitioner is not, in any manner, precluded from instituting or claiming such compensation as the petitioner may be advised. The compensation fixed by respondent nos.1 and 2 would not limit or constrain the petitioner in any manner from instituting appropriate action in this regard.
3.
In this view, the learned counsel appearing for the petitioner seeks to withdraw the present petition.
4.
The petition is dismissed as withdrawn. The pending application is also disposed of.
5.
It is further clarified that the petitioner is also at liberty to file it afresh, in the event it is found that the respondent no.1 and 2 are duly empowered to compute the compensation and the compensation, so determined, is binding on respondent no.4.
