% 07.11.2019 The case of the prosecutrix is that she had known the petitioner for the last 2 to 2 1⁄2 years. She stayed as his wife for three months in a rented accommodation and thereafter they went to stay in the house of the petitioner, where they stayed for around 15 days. However, the police came to know and both the petitioner and the prosecutrix were arrested. Further, when she went to stay at her home with the petitioner, she came to know that the petitioner was already married and had a child of four years of age. When she requested the mother of the petitioner to let her go, she was told to let the matter cool done. Further, on the last night, she had stayed at Nirmal Chhaya. It is the case of the prosecutrix that she has been duped by the petitioner and therefore prays that the petitioner must be punished. The said statement of the prosecutrix is supported by her in the Court. Learned counsel for the accused-petitioner submits that the
petitioner is in judicial custody since 26.05.2018 and out of 13 PWs, only prosecutrix has yet been examined and hence, the trial will take its own time. It is therefore, prayed that the petitioner be granted bail. Learned APP has opposed the present application on the ground that the allegations against the petitioner are serious in nature and on the date of the incident, the prosecutrix was only 14 years of age and thus the instant bail application deserves to be dismissed. Keeping in view the serious allegations against the petitioner, statement of the prosecutrix on record and the fact that the petitioner is in JC since 26.05.2018, without going into the merits of the case, I am of the opinion that the present case is fit for bail. Accordingly, the petitioner be released on bail subject to his furnishing personal bond in the sum of Rs.15,000/- with one surety in the like amount, to the satisfaction of the Trial Court. The application stands disposed of.
