The Petitioner has been implicated in case FIR No. 130/2023 dated 31st August, 20231, registered under Sections 420, 468, 471 and 120-B of Indian Penal Code, 18602, at P.S. Tughlak Road, New Delhi. 2.

The Petitioner contends that despite considerable passage of time since the registration of the impugned FIR, the matter continues to remain under investigation and a chargesheet has not yet been filed. The Petitioner has also raised various grounds challenging the registration of the impugned FIR.

the State, upon instructions from the Investigating Officer, SI Rahul, submits that the final report under Section 173 of the Code of Criminal Procedure, 19733 shall be filed within a period of six weeks from today. This statement is taken on record.

In view of the above statement, the Counsel for Petitioner seeks leave to withdraw the present petition at this stage, while expressly reserving all rights and contentions, and submits that the Petitioner shall await the filing of the final report under Section 173 of CrPC. It is further submitted that, in the event the said report is adverse to the Petitioner, liberty may be granted to take recourse to appropriate remedies as available in law. 5.

Leave and liberty, as prayed for, are granted. It is clarified that in case the final report is unfavourable to the Petitioner, he shall be at liberty to pursue all legal remedies available to him.

All rights and contentions of the Petitioner are left open. 7.
