The learned senior counsel for the petitioner submits that in view of the order dated 23.12.2023 passed by the learned MM (NI Act), Patiala House Courts, New Delhi in CC No.1400/2020 titled as Kotal Mahindra Prime Ltd. v. Godawari Motors Pvt. Ltd., acquitting inter alia the petitioner herein, in the said case, as payment had been made by the Company, nothing survives in the present petition and therefore, he would like to withdraw the present petition.

Accordingly, the present petition as well as the pending application is dismissed as withdrawn.
