The present petition is filed seeking quashing of FIR No. 117/2025 dated 25.02.2025, registered at Police Station Adarsh Nagar for offences under Sections 85/316(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023.

The FIR was registered on a complaint given by the mother of the victim alleging that her daughter was subjected to cruelty at the hands of petitioners who are the husband, parentsin-law and brother-in-law of the victim. 3.

The learned counsel for the petitioners submits that the complainant only stayed in India for ten days and then moved to Canada with Petitioner No. 1. He submits that no incident of cruelty had ever taken place.

complaint given by the mother of the victim and not by the victim herself. He submits that the present FIR has been registered only to harass the petitioners and to pressurize Petitioner No. 1 in the divorce proceedings pending in the Court of Canada.

Concededly, the investigation is at a nascent stage. The Police, after considering the statements and the material on record, would file a final report. The same can also be in the nature of closure if no evidence is found against the petitioners. However, no order can be passed at this stage, not allowing the authorities to investigate especially when specific allegations have been made in the FIR.

The learned counsel for the State, on instructions, submits that, at this stage, subject to the petitioners joining investigation, no coercive steps are proposed.

In view of the above, this Court does not consider it apposite to entertain the present petition at this stage. 8.

The petitioners are at liberty to file an appropriate petition in case any grievance remains in future after the investigation is complete.

The present petition is disposed of with the aforesaid observations.
