This application has been jointly filed under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 ('CPC') for recording of compromise between the parties.

The application is duly signed by the authorized representatives of the plaintiff and the defendants and is also supported by an affidavit of the parties.

The terms of the settlement are recorded in paragraph 5 of the application.

4.

I have gone through the terms of the settlement and find the same to be lawful.

5.

The parties shall remain bound by the terms of the settlement. 6.

The application stands disposed of.

In view of the order passed above, the present suit is decreed in terms of prayer clauses 61(a), 61(b) and 61(c) of the plaint. The above-captioned application shall form part of the decree sheet. 8.

Let the decree sheet be drawn up.

In view of the fact that the matter has been settled between the parties at an early stage, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff, in terms of Section 16 of the Court Fees Act, 1870.

All pending application(s) stand disposed of. 11.

The date already fixed i.e., 17th January 2025, stands cancelled.
