This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- "a. Issue a writ, order, or direction in the nature of mandamus directing the Respondents to conduct a proper and impartial survey of the Petitioners;

b. Pass an order directing the DDA to not allot the flats made for In-Situ Rehabilitation of Jailer Wala Bagh JJ Clusters to the JJ Dwellers at Golden Park, Rampura, and clusters in front of Mata Jai Kaur School until the survey of all slum dwellers are carried out.

c. After some arguments, Ms. Kaur, learned counsel for the petitioners, states that in terms of Clause No. 6(B)(x) of the "Draft Protocol for Removal of Jhuggis and JJ Bastis in Delhi" approved by Delhi Urban Shelter Improvement Board (DUSIB), the petitioner shall appear before the Appellate Authority and the Appellate Authority may decide the cases of the petitioners based upon the provisions of the policy's rules and regulation. 3.

The said Clause No. 6(B)(x) of the Draft Protocol for Removal of Jhuggis and JJ Bastis in Delhi reads as under: "(x) In addition to the above prescribed procedure, if any genuine case(s) is/are still left out, then the Appellate Authority, to be constituted as per the provisions of the Policy, may consider the same as per individual merit of the case."

Granting the said liberty to the petitioners, the present petition is disposed of.

The interim order dated 23.08.2023 shall continue till the representation of the petitioners is disposed of by the Appellate Authority.
