The present suit has been filed seeking permanent injunction and damages from the defendant in relation to a television commercial which was used by both the parties in the year 2012, wherein, the plaintiff claims that the commercial used by the defendant was disparaging of the plaintiff's products as well as substantial copy of the same. 2.

The parties were directed to take instructions when the matter was listed on the last date of hearing.

Today, learned counsel appearing for the plaintiff submits that he has taken instructions that since the television commercial has not been run by the defendant since the year 2012, the present suit can be disposed of. 4.
