FAO(OS) (COMM) 20/2018 and CM Nos. 4133/2018 Counsel for the appellants seeks permission to place on record true copy of the order dated 01.02.2018. The same is taken on record and would be attached to the appeal file.

Counsel for the appellants and respondents state that the witness namely Mr. Robert Andersen has been examined. Learned counsel for the appellants states that in view of the aforesaid position the present appeal may be disposed of as withdrawn and infructuous

leaving the question open, with right to the appellant to raise the issue of presence of Dr. Yuriy Reznic at an appropriate stage and as per law.

Learned counsel for the respondents states that the reasons given in the impugned order are correct. In case any objection and plea is raised by the appellant, he will meet the argument and raise all contentions.
