% 07.11.2019 The learned counsel on instructions submits the appellant be granted time till 30.04.2020 to vacate the premises. Learned counsel for the respondent says on instructions from Mr.Joseph E.Anthony, Secretary of the Society that in case the appellant would vacate the premises by 30.04.2020 the respondent shall not execute the decree qua the mesne profits/damages/costs etc and shall forgo such amount. Since the appellant is inclined to vacate the premises on or before 30.04.2020 and since the respondent says in case the appellant vacates the premises and handover its peaceful possession to the respondent, they shall not claim the decretal amount qua mesne profits and user charges; the appeal is disposed of on filing undertakings to such effect by both the parties. Pending applications, if any, also stand disposed of.

Undertaking be filed within two weeks from today with copies to either parties.
