O R D E R

% 08.02.2016 Petitioner is aggrieved by the two orders. The first is the order dated14.5.2015. Since this petition has been filed after more than 8 months after the order had been passed, the petitioner is not challenging this order.

The second order to which challenge has been laid is the order dated 05.10.2015. Submission of the petitioner is that PW-1 was not competent to tender the evidence by way of affidavit as he is only the Power of Attorney of the plaintiff and an oral submission to this effect had been made before the Trial Judge but the Trial Judge had not recorded this submission.

This argument which has been made before this Court is minus the record. The record does not speak of any such objection taken by the petitioner before the Trial judge. This petition is dismissed as

withdrawn with liberty granted to the petitioner to make appropriate submission before the Trial Court.
