% 28.11.2019 Learned counsel for the petitioner submitted that he may be allowed to withdraw the petition with the liberty to move an application before the Trial Court to amend the reply filed before the Family Court, Karkardomma Courts, Delhi raising the plea regarding the maintainability of the petition under Section 125 of the Code of Criminal Procedure, 1973. Accordingly, the petition is dismissed as withdrawn with the liberty as prayed for subject to just exceptions. In case the petitioner moves such an application raising the aforesaid plea before the Family Court, Karkardooma Courts, Delhi, the Family Court may dispose of the same in accordance with law.
