The instant petition is filed seeking following reliefs: "a. Issue appropriate writ, order or direction in the nature of Mandamus and /or any other appropriate writ, directing the Respondents to return Fixed Deposit Receipt No. 17805646 dated 02.02.2022 for Rs. 2,00,000/- ( Rupees Two Lakhs Only) issued by ICICI Bank , Delhi -Vivek Vihar Branch got issued by the Petitioner in name of Deputy Commissioner of Excise, Delhi to the Petitioner;

b. Issue appropriate writ, order or direction in the nature of Mandamus and /or any other appropriate writ , directing the Respondents to return Fixed Deposit Receipt No . 17805647 dated 02.02.2022 for Rs. 2,00,000/- (Rupees Two Lakhs Only) issued by ICICI Bank, Delhi-Vivek Vihar Branch got issued by the Petitioner in name of Deputy Commissioner of Excise, Delhi to the Petitioner; and c. pass any other or further writ or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case be also passed by the Hon'ble Court in favour of the Petitioner and against the Respondents."

Mr. Abhinav Sharma, Advocate., learned counsel appearing on behalf of respondent, places on record the copy of communication dated 22.04.2026 made to M/s Aaroha Alcobev Distributors Private Limited. copy thereof has been sent to the petitioner. The said communication is extracted as under:

"Sub: Reference your letter dated 27.01.2026 for withdrawal of FDRs for the companies with Aaroha L1 License Year 2021-22. With reference to your request letter dated 27.01.2026, you are hereby informed to submit your request with Name & Branch of the issuing Bank, FDR Serial Number, Amount, License Year in which FDR was deposited, Affidavit affirming No Dues pending with the department as on date etc. being the L-1 license holder.

Your are directed to submit the same at the earliest to process your request further as per the Delhi Exicse Act, 2009 and rules and guidelines framed thereunder."

It is thus, seen that the respondent - department is agreeable to return the Fixed Deposit Receipt (FDR), subject to compliance with the requirement as mentioned in communication dated 22.04.2026. 4.

Let the petitioner to take appropriate steps and to pursue with the department through M/s Aaroha Alcobev Distributors Private Limited. If the petitioner does so, let the grievance as stated above be dealt with without any further delay.

With the aforesaid observations, the instant petition stands disposed of.
