The petitioner is a Director of M/s Aerens Jai Realty Private Limited (formerly known as Aerens Builders Pvt. Ltd.) and has filed the present petitions impugning notices for recovery of outstanding demands in respect to the said company under Section 179 of the Income Tax Act, 1961 [the Act]. The said demands sought to be recovered are in respect of Assessment Years [AYs] 2008-09 to AY 2012-13 and AY 2014-15. 2.
The learned counsel appearing for the Revenue, on advance notice, submits on instructions that the recovery proceedings that are sought to be impugned are not being continued and an appropriate order would be passed dropping the said proceedings. proceedings are to be continued based on the said documents, the Department would take appropriate steps.

In view of the above, no further orders are required to be passed in these petitions. However, we direct that in the event the Department seeks to revive the recovery proceedings, they will give due intimation of the same to the petitioner.
