A Writ Petition under Article 226 of the Constitution of India read with Section 528 BNSS has been filed on behalf of the petitioner for grant of Parole to the Petitioner for four weeks in case FIR No.239/2013 under Section 377 IPC & Section 6 POCSO Act Police Station Vijay Vihar, Delhi, whereby the Applicant is undergoing Sentence of life and fine of Rs.5,000/-. 2.

It is submitted in the Application that the Applicant/Petitioner had applied for parole for four weeks on 16.04.2025 as per Daily Prison Rules, 2018. The Application was duly received in Home, General Department, GNCT of Delhi, but no reply has been received even after 30 days. Hence, the Petition has been filed for grant of Parole of four weeks on account of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Learned APP on behalf of State has submitted that she had jumped the emergency Parole and could be arrested only on 30.05.2024. Moreover, the Verification Report from District Mainpuri about the marriage has not been received till date.

Considering the grounds given in the Petition for Parole on account of the marriage of the brother of the Petitioner on 02.06.2025,the Parole is granted for a period of two weeks on the following terms and conditions: - i. The Petitioner shall furnish a personal bond in the sum of Rs.10,000/- with one surety of the like amount, to the satisfaction of the Jail Superintendent.

ii. The Petitioner shall report to the SHO of the local area once a week on every Sunday between 10:00 AM to 11:00 AM during the period of Parole.

iii. The Petitioner shall furnish a telephone/mobile number to the Jail Superintendent as well as SHO of local police station, on which he can he contacted, if required. The said telephone number shall be kept active and operational at all the times by the Petitioner.

iv. The Petitioner shall ordinarily reside at the address mentioned in the Petition.

v. Immediately upon the expiry of period of Parole, the Petitioner shall surrender before the Jail Superintendent. vi. The period of Parole shall be counted from the day when the Petitioner is released from jail.
