The present petition has been filed under Section 439 CrPC seeking interim bail for a period of two months in connection with FIR No.0094/2024 under Sections 376/498A/506/34 IPC registered at PS Shaheen Bagh, to enable the petitioner to take his BBA, fourth semester examinations being conducted by Jamia Millia University. The date sheet of the petitioner is mentioned in para 2 of the main petition, which is as under: a) 15 May, 2024: Entrepreneurship (CBCS) b) 04 June, 2024 : Corporate Accounting c) 11 June, 2024 : Fundamentals of Marketing The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
d) 21 June, 2024: Fundamentals of Investment e) 25 June, 2024 : Organizational Behavior 2.
The exam of Entrepreneurship (CBCS) has already been taken by the petitioner on 15.05.2024. The next exam of Corporate Accounting is scheduled on 04.06.2024 and for this purpose the custody parole has already been granted to the petitioner. Insofar as the remaining exams are concerned, the same are scheduled for 11.06.2024, 21.06.2024 and 25.06.2024. The petitioner is confining his prayer of interim bail only for the purpose of taking his said exams.

Notice in the application was on 29.05.2024 with a direction to the State to file a status report.

Learned APP for the State has handed over a status report today in the Court. A perusal of the status report shows that the factum of examination has been verified.

In view of the above, the petitioner is granted interim bail till 26.06.2024, subject to his furnishing a Personal Bond in the sum of Rs. 15,000/- and one Surety Bond of the like amount to the satisfaction of the Trial Court/CMM/Duty Magistrate, further subject to the following conditions:- a) petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned.
b) petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The application stands disposed of.

After the expiry of interim bail, the petitioner shall surrender before the Jail Superintendent on 27.06.2024.
