O R D E R

% 24.03.2017 1.

The learned counsel for parties state that the parties have settled their disputes in terms of their respective statements as recorded by the learned Joint Registrar on 21.03.2017.

Mr Mukesh Gupta, the sole proprietor of the plaintiff has affirmed as under:- "Neither I nor my family members nor any company/partnership concern in which I or my family members are partners/Directors will claim any right with respect to the registered trademark "MAX Dry Cleaners International" of the defendant from any Court/Authority."

The defendant has also affirmed as under:- "I undertake that neither I nor my family members or any company/partnership concern in which me or my family members are partners/Directors, shall open a dry cleaning shop within 2 kilometer radius of the plaintiff's shop at Sarojini Nagar Market."

The learned counsel for the parties request that the suit be decreed in terms of the respective statements made by the parties. 5.

The parties are bound down to their statements as recorded on 21.03.2017 and the suit is decreed in terms thereof. Let a decree sheet be drawn up accordingly.
