The present petition has been filed under Section 439 CrPC read with Section 482 CrPC seeking interim bail in connection with FIR No.0060/2024 under Sections 307/323/341/506/34/147/148/149 IPC and Sections 25/27 of the Arms Act registered at PS Hauz Qazi on the ground that the petitioner's wife has to undergo surgery. 2.
The complainant is also present in the Court and he states that he has no objection in case the petitioner is released on regular bail. 3.
On the request of the learned counsel for the petitioner, the present petition is treated as an application for regular bail under Section 439 CrPC. 4.
A status report is on record which shows that the petitioner's wife has to undergo surgery and she has to be admitted in the hospital for the said purpose on 10.06.2024.

On a query posed by the Court, learned APP, on instructions from the IO who is present in the Court, states that the injury suffered by the complainant was simple in nature. that in all such cases the petitioner is already on bail. 6.
It is also not the case of the prosecution that the petitioner is a flight risk.

In view of the aforesaid circumstances stated hereinabove, this Court is of the view that the petitioner has made out a case of regular bail. Accordingly, the petitioner is admitted to regular bail subject to his furnishing a Personal Bond in the sum of Rs. 25,000/- and one Surety Bond of the like amount to the satisfaction of the Trial Court/CMM/Duty Magistrate, further subject to the following conditions: a) petitioner shall appear before the Court as and when the matter is taken up for hearing.
b) petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned.
c) petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses. 8.
The application stands disposed of.

Copy of the order be forwarded to the concerned Jail Superintendent for necessary compliance and information.
